Summary
This Undergraduate Dissertation consists of a legal analysis of work-life balance measures in the Spanish legal system, with special attention to the care of minors. Through the examination of national and European regulations, scientific doctrine, and recent judicial rulings, the various instruments that allow workers to reconcile their professional responsibilities with family duties are analyzed, highlighting both progress and shortcomings in their application. Two groups of measures are examined: rights related to presence, such as work schedule adaptations and working conditions, and rights related to absence, focusing on paid leave and reductions in working hours. The study identifies significant legislative advances but also emphasizes the lack of shared responsibility and the persistence of gender stereotypes. It concludes that, to achieve an effective work-life balance, it is necessary to strengthen legal guarantees and promote a cultural change that encourages an equitable distribution of family responsibilities.

These challenges are related to the fact that the work is carried out within private households and from the legal and practical limits this involves. The study begins with a conceptual and regulatory analysis of the sector, followed by an examination of the main occupational risks faced by HCS aides, with special attention to psychosocial risks and gender-related factors that increase exposure to workplace harassment and violence. A gender perspective is adopted throughout as a key analytical tool, considering the feminization of the sector and the particular vulnerability of workers, many of whom are migrant women. Finally, the role of the Labour and Social Security Inspectorate in this area is analyzed, highlighting the legal and practical limitations it faces when acting in private households, which severely hinders effective monitoring of working conditions.

This paper analyzes the lead case procedure following the reform of the Spanish Law Regulating Social Jurisdiction (LRJS), examining its basis, legal foundation, requirements, and functioning; from the moment it is identified by the judicial body to the potential extension of the effects of the final judgment in the lead case to the suspended proceedings, as well as the conditions and limits of such extension. Furthermore, the paper explores its relationship with traditional procedural figures, such as joinder of actions and cases or the collective dispute procedure. As the topic unfolds, a series of questions and challenges are raised regarding its implementation in the social jurisdiction, due to its highly innovative nature. The main objective of the test-case procedure is to speed up case resolution and improve procedural efficiency and economy within the social jurisdiction. The paper concludes that, although this procedure has the potential to meet its intended objectives, its success will depend on factors such as proper judicial implementation, allocation of resources to the courts, and the resolution of the many legal uncertainties it presents.

Based on existing scientific literature and information provided by experts, an exhaustive description of all the stages involved in selection processes is presented (profile definition, recruitment, tools, and procedures). Furthermore, a wide range of evaluation tools is examined, and a comparison is made with their application in Temporary Employment Agencies. Finally, a series of suggestions or recommendations are proposed, which can be implemented by the staff of client companies to improve the person-job fit achieved in the selection processes conducted by Temporary Employment Agencies.

In a scenario shaped by technological progress and the increasing digitalization of labor relations, it is necessary to define the legal boundaries governing employer monitoring measures, ensuring a balance between the employer’s legitimate organizational authority and the protection of workers’ dignity and privacy. The research begins with a legal analysis of the Spanish and European regulatory framework, as well as relevant legal doctrine and case law, to assess the legality of video surveillance practices in the workplace. In particular, it examines the requirement for prior information, the circumstances under which hidden cameras are permitted, specially protected areas, and the application of the proportionality test as a key standard for evaluating the legitimacy of control measures. The paper also analyzes the main conflicts that arise in judicial practice, offering a detailed review of key rulings such as the López Ribalda case from the ECtHR and Spanish Constitutional Court Decision 39/2016. Finally, practical recommendations are provided for an approach to workplace video surveillance that is effective, proportionate, and respectful of fundamental rights.

Summary
The purpose of this paper is to analyze the strategic management of human resources in a SME, in this case the company Martínez Otero, evaluating the functioning of its processes, identifying strengths and weaknesses and proposing improvements to optimize the acquisition and management of talent. For the development of the analysis, several methodologies were used. Firstly, the PESTEL and SWOT tools were applied to examine both the external factors that affect the company and the strengths, weaknesses, opportunities and threats linked to human resources management and the general management of the company. A survey was also conducted for employees about the selection process and some general aspects of their work. In addition, to complete this information, an interview was conducted with the human resources director to obtain more detailed information about the selection processes. In relation to the conclusions obtained, it should be noted that the company studied has efficient human resources management adapted to its current needs,which contributes to a favorable work environment and adequate retention of talent. However, as a result of this analysis, opportunities for improvement are also seen through the implementation of new strategies that complement existing ones, especially in personnel selection processes, in order to reduce time and improve the efficiency of the process. Finally, this analysis highlights the importance of the strategic approach in the management of human resources for SMEs, particularly in sectors where specialization and product quality are determining factors for success. The use of strategic tools is essential to anticipate changes that may arise, optimize company resources and make decisions that strengthen and help maintain the competitive position of the organization.
The purpose of this paper is to analyze the strategic management of human resources in a SME, in this case the company Martínez Otero, evaluating the functioning of its processes, identifying strengths and weaknesses and proposing improvements to optimize the acquisition and management of talent. For the development of the analysis, several methodologies were used. Firstly, the PESTEL and SWOT tools were applied to examine both the external factors that affect the company and the strengths, weaknesses, opportunities and threats linked to human resources management and the general management of the company. A survey was also conducted for employees about the selection process and some general aspects of their work. In addition, to complete this information, an interview was conducted with the human resources director to obtain more detailed information about the selection processes. In relation to the conclusions obtained, it should be noted that the company studied has efficient human resources management adapted to its current needs,which contributes to a favorable work environment and adequate retention of talent. However, as a result of this analysis, opportunities for improvement are also seen through the implementation of new strategies that complement existing ones, especially in personnel selection processes, in order to reduce time and improve the efficiency of the process. Finally, this analysis highlights the importance of the strategic approach in the management of human resources for SMEs, particularly in sectors where specialization and product quality are determining factors for success. The use of strategic tools is essential to anticipate changes that may arise, optimize company resources and make decisions that strengthen and help maintain the competitive position of the organization.

Based on the recognition of employment as a fundamental right and an essential means of social inclusion, an analysis is carried out of the legal provisions, both international and national, that regulate this matter. It examines, among others, the Convention on the Rights of Persons with Disabilities, the Spanish Constitution, the General Law on the Rights of Persons with Disabilities, and the Basic Statute of Public Employees, as well as specific regulations of some autonomous communities. The project delves into the affirmative action measures implemented, such as reserved positions and reasonable accommodations, as well as their effectiveness in addressing persistent barriers. Finally, strategies are proposed to strengthen the guarantee of the principle of equality and promote a truly inclusive and non-discriminatory public service.

Until then, the lack of regulatory provisions in this area amounted to indirect discrimination, as it prevented women from taking leave from work for conditions inherent to their biology without compromising their labour rights or economic security. Nevertheless, the integration of these special situations requires a broader approach to ensure the health and well-being of not only women, but also other marginalised groups in the workplace. In this regard, this study aims to analyse those circumstances that have a significant impact on a worker’s ability to work and currently lack specific regulation. In particular, it focuses on situations that may be recognised as protected contingencies, specifically, menopause, assisted reproduction treatments, and challenges experienced by people with disabilities. This empirical study aims to examine whether the differences in the management of the SAF between the municipalities of Tordoia and Trazo (direct hiring by the Tordoia Council and external hiring by the Trazo Council) affect the prevalence of burnout, and the perception of Emotional Intelligence (EI) and the performance of the Home Help Service (SAF) workers. To determine this, the Maslach Burnout Inventory (1981), the Wong and Law EI Scale (2002), the Job Performance Scale adapted from Black and Porter (1991), and a questionnaire on working conditions developed by the authors were administered to people belonging to this service in both municipalities. Finally, the sample obtained was 25 home care workers, which represents almost 100% of the SAF workers from both municipalities. Likewise, this sample is composed only by women and has an average age of 50.36 years. The analyses carried out showed very similar results for both municipalities; the workers from both did not present high levels of burnout and only showed moderate levels of exhaustion and depersonalization in the case of the Trazo sample. Regarding EI and job performance, the results showed high levels for both variables. Finally, in relation to working conditions, greater differences were found in items related to job satisfaction and job evaluation. The results of this study seem to indicate that the SAF management system does not significantly affect the levels of burnout, emotional intelligence, or job performance. However, differences in working conditions were detected between both municipalities. The implications of these results are analyzed in the discussion section of this paper.

This Final Degree Project addresses occupational risk prevention in the wine sector, a field with unique characteristics due to the combination of agricultural, industrial, and logistical activities. Based on the general regulatory framework of Law 31/1995 on Occupational Risk Prevention (PRL) and its regulatory development, the main risks present throughout the entire wine production process are identified and described: from vine cultivation to bottling, including harvesting, transport, the winery, and the fermentation and aging phases. The thesis covers ergonomic, chemical, biological, spatial, and psychosocial risks, proposing specific preventive measures for each task. Likewise, it analyzes the role of risk assessment, training, the use of PPE (Personal Protective Equipment), emergency plans, and digitalization as key elements to ensure a safe environment. Practical and regulatory references are included, as well as technical materials from organizations such as INSST and ISSGA. The approach is based on both theoretical analysis and my personal experience in a family winery in Ribeira Sacra, providing a realistic and applied perspective on the shortcomings and opportunities in preventive management within the sector.

From a sample of 103 workers, it examines how the domestic and family environment interferes with the work environment, with special attention to gender differences. The results conclude that, although there are no significant differences in the mean scores between men and women in the variables studied, specific correlations that vary according to sex are identified. Specifically, it was found that greater co-responsibility in the home is associated with a lower perception of double presence and, in turn, that this double presence is directly linked to work-related stress, particularly in women. Moreover, women with greater domestic and family burdens do not perceive a worse performance, but rather have a higher perception of it, which can be explained by the mechanisms of self-demand and overexertion. The theoretical and practical implications of the results obtained are described in the discussion section of this paper.

Based on the data collected, we can conclude that in recent years, Galicia has seen a considerable reduction in unemployment rates, standing out among Spanish autonomous communities for the evolution of labor market behavior. This conclusion, which should be good news, actually hides a series of structural problems linked to the gradual and constant aging of the population and the lack of job opportunities. This inevitably leads us to enter a cycle that continues to accentuate this serious problem facing our community, which is none other than: Lack of opportunities, emigration of new people in search of these opportunities in other regions, an aging population, … This paper examines the factors that explain this phenomenon from a structural economic and demographic perspective. Through a comparative and analytical approach, it highlights the change in the Galician production model, active employment policies, demographic developments, and territorial resilience in the face of recent economic crises. The analysis concludes that the improvement in employment in Galicia is the result of a combination of internal transformations and external factors, and offers recommendations for consolidating this trend through comprehensive policies that promote and stabilize employment. In the context of the Spanish labor market, Galicia has shown a specific evolution. Since 2013, the autonomous community has experienced a considerable and sustained decline in its unemployment rate, reaching figures below the national average. This trend is the subject of a study that seeks to understand the factors that led to this progress and its possible extrapolation to other territories. The main objective of this paper is to analyze the factors that contributed to the reduction in unemployment in Galicia. To do so, we analyze unemployment data, demographic data, and migration movements. Historically, Galicia has had unemployment levels higher than the European average, although lower than those recorded in other Spanish regions. Following the 2008 economic crisis, the unemployment rate in Galicia peaked in 2013, reaching 22.04%. However, since then, a progressive decline has been observed, with employment recovering more solidly than in other autonomous regions. According to data from the Spanish National Employment Agency (EPA), the unemployment rate in Galicia stood at 9.38% in 2024, compared to the national average of 11.35%. This positive trend must be understood not only in quantitative terms but also in qualitative terms, considering the quality of the jobs generated, their sustainability, and their adaptation to changes in the global economic environment. Compared to regions such as Andalusia, Castilla-La Mancha, or Extremadura, Galicia has shown greater stability in terms of employment. However, it still lags behind regions with more diversified and industrialized economies, such as the Basque Country and Navarre. This intermediate position offers an opportunity to analyze the differential factors that explain its better performance compared to other regions.

This study analyzes the influence of subjective well-being on job search expectations and perceived employability among university students. Research was conducted with 146 students enrolled in the Degree in Labour Relations and Human Resources at the University of Santiago de Compostela. Participants completed a questionnaire assessing their evaluation of various organizational characteristics and job search methods, their expectations regarding the job search process, their perceived employability, and their level of subjective well-being. The results indicated that participants considered most organizational attributes and job search strategies to be important. Among the most highly rated characteristics were a positive work environment, job flexibility, and competitive remuneration. The most effective job search methods were perceived to be preparing for civil service exams, reaching out to friends already employed, and sending unsolicited CVs to companies. Women rated many organizational aspects (e.g., corporate culture, positive atmosphere) significantly higher than men, and participants with prior work experience placed more importance on aspects such as salary. Regarding well-being variables, higher life satisfaction and greater positive affect were associated with higher perceived employability, whereas negative affect showed only a weak correlation. Similarly, factors related to job search expectations were positively correlated with perceived employability. Lastly, women reported significantly higher levels of perceived employability than men, with no significant differences according to work experience. In conclusion, the study highlights the importance of subjective well-being and positive expectations in the job search process, suggesting that enhancing university students' well-being and confidence may improve their perceived employability and, potentially, their actual employment outcomes.
This study analyzes the influence of subjective well-being on job search expectations and perceived employability among university students. Research was conducted with 146 students enrolled in the Degree in Labour Relations and Human Resources at the University of Santiago de Compostela. Participants completed a questionnaire assessing their evaluation of various organizational characteristics and job search methods, their expectations regarding the job search process, their perceived employability, and their level of subjective well-being. The present study investigates the effect of generational diversity on Job Satisfaction and Job Involvement within the context of a local public administration. Organizations are composed of employees belonging to diverse generations, each possessing distinct values and expectations, which can pose a considerable challenge for Human Resources management. Differences in employee priorities exist, contingent upon their generational affiliation, which may consequently impact their connection to work. Previous literature has shown mixed results concerning whether these generational differences are reflected in the levels of Job Satisfaction or Job Involvement in the private sector. A meta-analysis, for instance, indicated typically low or non-significant effects. Building upon this evidence, the hypotheses posited that no significant differences would be found in Job Satisfaction (both globally and across its dimensions: satisfaction with supervision, the physical environment, and benefits) nor in Job Involvement (both globally and across its factors: Psychological Identification and Duty-Obligation). The study was conducted with 61 employees from a local public entity, notably highlighting a predominance of Generation X within the sample. The Job Satisfaction Questionnaire S10/12 and the Castilian adaptation of the Job Involvement scale were employed as instruments to measure the constructs. The empirical findings corroborated the proposed hypotheses, revealing minimal or statistically non-significant variations in the degrees of Job Satisfaction and Job Involvement among the different generations.

This undergraduate dissertation aims to analyze the legal treatment that the Spanish Holy Office gave to madness, its difficulty in assessment, social consideration, and its function as a mitigating or exculpatory factor. To this end, the study is based on the mechanics of the inquisitorial process, the integration of the Inquisition into monarchical power, and the analysis of the concepts of sin, crime, and intent. According to the standards of the Old Regime, committing a crime requires intent; therefore, the Spanish Holy Office, dedicated to prosecuting predominantly spiritual offenses, constructed a superficial and ambiguous system to modulate punishment based on the degree of criminal responsibility that an individual could be considered to have, according to their own traits or the circumstances of the crime. Its assessment was strongly influenced by the inquisitor’s judgment and social stereotypes, and its treatment was situated between Christian charity and the marginalization of the mentally ill. A bibliographic review and the analysis of legal texts and case files from the period reveal that madness, as a modifying circumstance of responsibility, was practically used as an abstract category encompassing all kinds of atypical social behaviors. Likewise, it was doubly employed to legitimize inquisitorial activity while also serving political purposes by neutralizing discourses potentially dangerous to the social order. There is limited information about the appreciation of madness by the Galician inquisitor; however, the studied faith processes help construct the ideological and terminological panorama in which the tribunal of Santiago framed mental alienation.

This is done through a practical approach that examines the internal organization of the company, personnel management (recruitment and retention of talent), work-life balance management systems and employees' personal and work-life balance. In addition, a series of proposals for improvement on corporate sustainability are included, through the United Nations Sustainable Development Goals. As for the methodology of both internal and external analysis, tools such as PEST, SWOT or CAME will be used to identify areas for improvement and detect possible problems. This will also allow us to generate concrete proposals and align all the company's values, from ethical to environmental values. This report combines the study of the company with realistic proposals on the current needs of the company in relation to the environments in which it operates.

This paper analyses how Chilean youth perceive the distribution of household chores and childcare and education, as well as gender differences and family time use. The results of this research show that mothers assume most household chores and childcare and education, while fathers are more involved in aspects such as household maintenance and financial management. Co-responsibility between parents and adolescents remains low. Finally, the data suggest that fathers may invest more time in household chores and care for dependents when their children are male than when they are female, while mothers do not make these distinctions. The results of this study are discussed at the end of this paper.

For years, people working in domestic service have been excluded from the basic rules of occupational risk prevention, as if cleaning, cooking, or caring for others in someone else’s home did not also involve pushing furniture, handling chemical products, or being at risk of falls. This legal gap began to form when Spain transposed, without adaptation, Council Directive 89/391/EEC of 12 June 1989 on the introduction of measures to encourage improvements in the safety and health of workers at work, and reflected it in Law 31/1995 of 8 November, on the Prevention of Occupational Risks (LPRL), which stated that the family home was not, for preventive purposes, considered a workplace. Since then, arguments such as the inviolability of the home or the non-profit nature of the private employer have been used as excuses to keep a predominantly female group in a state of legal vulnerability. This thesis explains why such excuses are no longer valid and outlines the main reasons that led to the latest shift in the legal preventive treatment of this sector. In this regard, it is worth highlighting: 1) the judgment of the Court of Justice of the European Union (CJEU) from February 2022; 2) the ratification of ILO Convention No. 189; and 3) the reforms introduced, first by Royal Decree-Law 16/2022 and later by Royal Decree 893/2024. In this context, the paper examines the strengths and weaknesses of the new regulatory framework, outlines the risks that are still present in households, and assesses the usefulness of the public tools available to employers to comply with their new obligations. Ultimately, the goal of this Final Degree Project is to demonstrate that only a technical regulation adapted to the home environment can ensure real and effective protection, comparable to that enjoyed by other wage earners.

The lack of co-responsibility for care, the glass ceiling and the gender pay gap are some of the impediments or barriers that women face in the labour market. As a result, nowadays they are the ones who have the more precarious jobs, accepting part-time work or also taking advantage of reduced working hours schemes to take care of their children and dependent family members. It requires greater effort to balance both their work and personal lives, since they are still largely the ones responsible for caregiving. And at the end, in monetary terms it also has a negative impact on them, since a high wage gap may indicate that women are concentrated in lower paid sectors or that a significant proportion of them work part-time. To this end, the latest data released by the Wage Structure Survey (ESS) will be analysed, as well as other statistical data produced by the National Statistics Institute (INE).

The stay in penal institutions, dedicated to serving the sentences imposed, is characterised by the objective of reeducating and reintegrating offenders into society. To this end, vocational training and prison labour play a key role, providing inmates with both theoretical and practical training to enable them to function effectively in the external labour market upon completion of their sentence. This academic paper addresses the special employment relationship of sentenced inmates, examining its regulation both in Organic Law 1/1979 of 26 September, the General Penitentiary Law, and in Royal Decree 782/2001 of 6 July, in order to understand its features: the beginning and end of the employment relationship; rights and obligations of inmate workers; pay structure and regime; organisation of work; etc. Social Security issues (benefits, requirements, special circumstances, etc.) are also analysed, with a comparison to the protection afforded in ordinary employment relationships, and an exploration of the reasons if any for potential disparities. Intelligence activity is no longer an exclusive activity of the States, as technological evolution and cultural changes have expanded the use of intelligence to business organizations. It finds great utility in evidentiary activities, with traditional intelligence gathering activities being included in business control, giving rise to a constant generation of evidentiary information, especially thanks to the use of technology; and which are reclassified to the traditional forms of evidence regulated by our LEC, despite their ineffectiveness, or difficulties in fitting, given the notable differences in their characteristics, intensity or mode of production, being notable the possible systematic violation of fundamental rights, and the extensive use of new technologies; for this reason, the importance of intelligence in the world of work is analyzed, as well as the conditions of procedural validity, in the social order, of intelligence activities adopted in the form of business control, and the creation of a new type of evidence is proposed, which allows for a more guaranteeing procedural regulation.

Through a descriptive literature review, an analysis of twenty scientific studies published preferably between 2020 and 2025 has been carried out, which serve to understand the individual, organisational and contextual variables that condition the willingness and commitment of employees towards environmental practices. This thesis is based on the fact that environmental behaviour is not predetermined by imposed rules or isolated actions, but is truly influenced by personal, organisational and contextual factors. The results obtained present the growing trend in the scientific literature on the study of voluntary environmental behaviour, referring to the importance of ethical leadership, internal communication, environmental training and staff involvement. In addition, some gaps were noted, such as the absence of prospective studies, the under-representation of some areas and a suggestion to include an intersectional perspective. The paper concludes with some practical recommendations for the organisation and possible lines of research that could help to improve environmental workplace cultures.

A detailed examination of the main types of labor contracts is presented, highlighting their characteristics, implications, and relevance for both workers and employers. The thesis also addresses the role of self-employed workers, who constitute a vital segment of Spain’s productive system. Despite a continued rise in their absolute numbers, these workers face significant challenges, such as high tax burdens, demographic aging, and insufficient generational turnover. The analysis includes recent statistical data on sectoral and regional variations and integrates the perspectives of freelancers regarding the future viability of their businesses. In the second half of the study, attention turns to labor inequality, focusing on the persistent gender pay gap. The thesis distinguishes between gross and adjusted pay gaps and analyzes both horizontal and vertical occupational segregation. Various structural causes are explored, including the underrepresentation of women in high- paying sectors and managerial roles, and the overrepresentation in lower-wage, care- related occupations. The impact of the COVID19 pandemic is also assessed, revealing how it disproportionately affected women in terms of unpaid care responsibilities, job stability, and psychological strain. Finally, the thesis evaluates the effectiveness of recent public policies, such as the Equal Pay Act and mandatory company equality plans. Although these initiatives represent crucial steps toward reducing labor inequality, the study emphasizes that their success hinges on rigorous implementation and institutional commitment. Overall, the research underscores the urgent need for structural reforms that ensure fair, sustainable, and inclusive employment anchored in social justice and real gender equality.

Some of the behaviors most frequently experienced by students were staring, agreeing to meet voluntarily, comments on a classmate's physical appearance, coinciding at a party or gathering, and initiating a relationship and voluntarily initiating a relationship with another classmate, thus coinciding with the behaviors least considered sexual harassment by students. This Final Degree Project analyses occupational risk prevention in the home care sector, with particular attention to the precarious working conditions faced by staff, marked by a high physical and emotional burden and limited preventive visibility. Through a qualitative methodology and document review, the main risks in the sector are identified, including physical, chemical, biological, psychosocial, and especially ergonomic hazards, as well as the preventive measures established in current occupational risk prevention regulations and their application in home environments. The importance of institutional commitment and adequate funding is emphasized in order to ensure effective and equitable prevention, while also incorporating a gender perspective and the need to improve working conditions in this field.

This Final Degree Project explores multiculturalism within the context of the company Innotur Consultoría e Innovación S.L., analyzing its perception, benefits, challenges, and management strategies. Using a mixed methodology combining questionnaires and interviews the findings reveal that multiculturalism is a key strategic advantage, fostering innovation and enabling adaptation to diverse markets. The company manages this diversity mainly through an inclusive organizational culture and informal integration dynamics. However, the lack of formal intercultural training is identified as an opportunity to further enhance its benefits and mitigate minor challenges. This study opens new lines of research on cultural diversity management and the impact of intercultural training in business environments.

It was psychologist Christina Maslach who first raised awareness of the existence and study of this concept, in addition to developing the Maslach Burnout Inventory (MBI), an internationally recognized tool for measuring the phenomenon. Officially recognized by the World Health Organization, burnout is considered a work-related problem, not a medical condition. It particularly affects professionals exposed to high emotional demands, such as teachers, nurses, and social workers. Ultimately, it is a risk to the mental health of workers in the workplace that reflects the need to assess personal, organizational, social, and workplace circumstances to improve well-being and productivity.

The objective of this work is to analyze the crime of stalking under article 172.ter of the Penal Code. Specifically, it aims to study it from a gender perspective, taking into account that one of the reasons it was incorporated into the legal system was to assume the obligations established by the 2011 Council of Europe Convention on preventing and combating violence against women and domestic violence for the States that are part of it. It also aims to explain how new technologies have impacted the methods and means used to commit acts of stalking. This is based on an examination of the current case law and doctrine on this crime.

The administrative procedure is a cornerstone of Administrative Law, regulating the actions of Public Administrations in their relations with citizens and in the pursuit of the general interest. Through a set of rules, procedures, and principles, this process ensures that administrative decisions are made with legality, transparency, and efficiency, protecting the rights of citizens and fostering trust in public management. In the Spanish context, Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations, establishes the main regulatory framework, harmonizing the actions at the state, regional, and local levels and incorporating advancements such as digitalization and administrative simplification. This Final Degree Project aims to comprehensively analyze the administrative procedure, exploring its stages (initiation, development, and conclusion), the guiding principles that underpin it, and the specific features applicable to procedures such as those related to sanctions or patrimonial liability. Additionally, it examines key aspects such as the notification and publicity of administrative acts, the correction of defects, and the adoption of provisional measures, highlighting their importance in ensuring fairness and legal certainty. The administrative procedure will also be distinguished from other legal procedures, such as judicial, arbitral, or legislative processes, to emphasize its unique characteristics and specific functions. The relevance of this work lies in the centrality of the administrative procedure within the functioning of the Rule of Law, as well as its ability to balance administrative authority with the protection of fundamental rights. In this dissertation pay transparency within European Union law and its role as a tool for the defense of equal pay between men and women will be analyzed. The origin of pay inequality based on gender and the role of pay transparency measures have on it, along with the conflicts that can arise due to them, will be researched through the use of academic papers, national jurisprudence and European Union law. There will be an analysis of previous European Union directives regarding equality between men and women in the work environment and of the more recent Directive (UE) 2023/970. This one will be analyzed in depth taking into account the pay transparency based measures it implements and its possible effectiveness. Since there is no transposition of this Directive to national Spanish law we cannot know without a doubt that the new strategy of the European Union of fighting against pay inequality with pay transparency is completely effective.

The protection of minors in the field of employment has been a constant concern in the development of Labour Law, as they represent one of the most vulnerable groups within this sphere. The present study aims to analyse the existing legal framework to ensure the adequate protection of minors, focusing on international, European, and national instruments. An in-depth analysis is carried out of the main conventions of the International Labour Organization, specifically Convention No. 138, which establishes the minimum age for admission to employment, and Convention No. 182, which addresses the worst forms of child labour. At the European level, the study examines Directive 94/33/EC on the protection of young people at work, as well as the European Social Charter and the Charter of Fundamental Rights of the European Union. Finally, at the national level, the regulation of child labour in the Spanish legal system is analysed from a threefold perspective: labour law, social security, and occupational risk prevention. This threefold approach allows the identification of existing legislative limitations and the need for further development in order to ensure effective protection of minors within the labour market.

This Final Degree Project analyzes the use and potential digital abuse among university students in relation to the right to digital disconnection. To this end, a theoretical review was combined with an empirical investigation based on a questionnaire that collected sociodemographic variables, a scale specifically designed to measure the time spent using different devices, a scale to assess problematic technology use, and two scales validated by Nguyen, Büchi, and Geber (2022) to analyze disconnection practices and motivations. The results show intensive use of digital devices, especially smartphones, although students do not perceive this use as abusive or dependent, expressing disagreement with statements related to abuse in the applied scales. Additionally, more time is spent on smartphones compared to computers for academic or work related activities. In terms of gender, no significant differences were generally identified in usage patterns and disconnection strategies, except for some isolated exceptions with limited relevance. In conclusion, these findings highlight the importance of students adopting a conscious and balanced management of their digital time, promoting effective disconnection practices that enhance their academic and personal well-being. Complementarily, university institutions could contribute to this goal through awareness campaigns to encourage healthy technology use.

The purpose of the present research was to analyze whether there is a relationship between the perception of a sports organization, the performance, both global and academic, and the satisfaction, both sports and life, of its users. The participants in this study are roller field hockey players in Santiago de Compostela. The EPOD scale (Nuviala et. al., 2008) was used to measure the perception of the sports organization and two other scales to measure performance and satisfaction. The sample consisted of 52 roller field hockey users, aged between 5 and 16 years. In order to facilitate the understanding and response to the questions of the scales, the parents or guardians of the users were the ones who answered them. The results showed that the factors of the perception of the organization presented high correlations with performance and satisfaction in the sport activity. Significant correlations were also found with academic performance and life satisfaction. The implications of the results obtained are described in the discussion section of this paper.

Based on the idea that emotional well-being and commitment to studies directly influence performance, a sample of 176 students from the Bachelor's Degree in Labour Relations and Human Resources at the University of Santiago de Compostela was analyzed. A validated questionnaire was used to measure the three main variables. Specifically, academic engagement was assessed using the Student Academic Engagement Scale (SAIS; Schaufeli et al., 2002), and emotional intelligence was measured using the Wong and Law Emotional Intelligence Scale (2002). The results show that both engagement and emotional intelligence are positively related to academic performance, although with moderate strength. Furthermore, it is confirmed that students with higher emotional intelligence tend to show greater commitment to their studies. This work highlights the importance of promoting emotional and motivational skills in the university environment to enhance academic success.

This bachelor’s thesis analyzes employer branding as a strategy to improve the perception, primarily internal, of the company’s image as an employer, and its relationship with three key organizational variables: job satisfaction, organizational commitment, and performance. In today’s labor context, marked by intense competition for talent and changing employee expectations, employer branding emerges as a tool capable of enhancing employees’ perceptions of the company, as well as their satisfaction, commitment, and performance. To this end, a Galician SME dedicated to metallurgy, composed of a staff of 20 workers, was selected. Through a structured questionnaire, employees’ perceptions of the key concepts under study were evaluated. The results reveal a high overall valuation of the organizational variables, although certain areas for improvement were identified, such as application value, benefits, or normative commitment, for which specific recommendations are proposed. This study enables an analysis of the applicability of employer branding in organizational contexts characterized by small-sized workforces, recognizing its value as a strategic tool for facing the challenges of the current labor market.

This Bachelor's Thesis aims to analyze occupational risk prevention for self-employed workers, a group that, due to their particular employment situation, faces specific risks that are not always adequately managed. In this context, the importance of implementing preventive measures tailored to the needs of these workers is addressed, as they often lack the necessary resources and training to ensure their safety in the workplace. An exhaustive analysis of current regulations on occupational risk prevention has been carried out, comparing the main differences between self-employed and salaried workers in terms of risk coverage and preventive policies. One of the key justifications for this work lies in the growing importance of the self-employed economy today. In a context where self-employment has experienced significant growth, especially in sectors such as transport, technology, and services, it is essential to ensure that self-employed individuals have the same safety guarantees as salaried workers. The study highlights that, although Spanish legislation includes measures to protect self-employed workers, many of them do not have access to the necessary resources to implement effective preventive practices due to a lack of information, training, or investment.

This final degree project seeks to share the relationship between the world of Galician refereeing and labor relations. It is based on a survey completed by referees from across the Galician community, from those in the lower categories to professional referees at the highest levels. The responses were used for the analysis and interpretation of statistical data and offer a very realistic picture of the behavior and work of Galician football referees, a figure that has always been a source of controversy among football fans. The referees who participated in this survey answered anonymously all kinds of questions, ranging from their place of residence to whether they had experienced conflictive situations outside of football stadiums due to having to officiate football matches played in all federated categories of the Royal Galician Football Federation.

Law 31/1995, of November 8, on the Prevention of Occupational Risks, adopts a traditional approach mainly focused on the male gender. As a result, the specific risks affecting female workers, especially in feminized sectors (such as healthcare or cleaning), are largely overlooked. These risks include those associated with maternity or natural breastfeeding, psychosocial risks, and chemical or biological risk. Carrying out a specific risk assessment that considers the personal and biological characteristics of female workers is essential, since inadequate evaluations may jeopardize the safety and health of female employees. Furthermore, it is worth mentioning that certain occupational diseases with a higher incidence among women are not recognized as such due to the absence of gender-specific risk assessments. This Final Degree Project identifies three types of occupational risks that highlight the importance of incorporating a gender perspective in risk prevention: protection during maternity and natural breastfeeding, psychosocial risks, and those present in female-dominated activities. Additionally, the project discusses preventive measures that integrate a gender perspective and the consequences of failing to incorporate this perspective into occupational risk prevention.

This Final Degree Project aims to offer a comprehensive analysis of the fundamental principles governing compulsory expropriation. Special attention is given to Articles one to thirty-five of the Law of December 16, 1954, on Compulsory Expropriation. Throughout this study, the essential requirements that legitimize expropriation will be identified and examined, namely the existence of a public utility or social interest, compliance with the legal procedure, and the right to receive fair compensation. The study addresses the constitutional foundations, the applicable legal principles, and the development of the expropriation procedure, including the initiation, instruction, and resolution phases. Likewise, the main guarantees offered to the expropriated party will be analyzed, as well as the limits imposed on public authority. The research concludes with a critical reflection on the effectiveness of the current regulatory framework, with the aim of ensuring a balance between the general interest and the protection of individual rights.

This paper focuses on analysing various aspects related to the regulation of working time, breaks and holidays in the Spanish labour framework, both from a normative and jurisprudential perspective, taking collective bargaining into account. It examines how Spanish legislation has evolved historically to establish clear limits on the maximum working day, taking the current constitutional framework as a reference. It also addresses the different categories of time within the working day, such as effective working time, availability time and rest. In this sense, specific cases are discussed, such as bathroom breaks or shift changes. The paper also explores the regulations on rest times, including short breaks during the day, daily and weekly rest, as well as paid annual holidays. The national and European provisions are examined, in particular Directive 2003/88/EC. Finally, the recent proposal to reduce the maximum weekly working day to 37.5 hours, announced in December 2024, is discussed.

This Bachelor’s Degree Final Project (BDFP) presents a straightforward study carried out on the teaching-learning process using the Internet, that is, e-learning or distance learning, focusing on its advantages and disadvantages, as well as its different modalities: e-learning, blended learning (B-learning), and mobile learning (M-learning), and its evolution since 1996, the year that marks its origin. I also analyse the contexts where it can be implemented, including training in educational centers and companies, the platforms available for delivering online training, and the elements that comprise them: content, synchronous and asynchronous communication systems, and MLS. In the second part, which contains the fundamental content of the BDFP, the study addresses the business sector by carrying out an analysis of the progress of this methodology in Galicia and Spain through the data provided by the State Foundation for Employment Training (FUNDAE). Finally, I address issues related to the current situation, on the one hand with a summary of the existing legislation concerning distance learning; also the subsidies available to facilitate the implementation of this type of training; and, to conclude, I present a brief survey of my own design developed to explore aspects related to e-learning and the interaction that professionals in my environment have with it: participation or non-participation in this type of training, changes perceived due to the pandemic, and the most commonly used applications.

The study of leadership styles is one of the most interesting topics within organizational behavior and work psychology, due to its relevance to the internal structure and functioning of the organization. Furthermore, the literature highlights the negative effects of work-related stress on employee well-being and performance, making it essential to analyze the variables directly associated with their prevalence and consequences for work. In this sense, the study of transformational leadership is one of the aspects that has received the most attention in recent years. The present study aimed to examine the prevalence of the transformational leadership style in a sample of workers, composed of both supervisory and non-supervisory participants. It also examined whether leadership style is related to workers' stress levels and job performance. The results suggest that when a transformational leadership style predominates in organizations, workers tend to experience a decrease in their perceived level of work-related stress, and in turn, an increase in performance. Consequently, the findings demonstrate how leaders can exert a significant influence on workplace well-being and on how workers perceive the work environment and climate. Finally, the theoretical and practical implications of the results are addressed in the discussion section of this paper. This section highlights the importance of paying special attention to the transformational leadership style, given its association with lower levels of stress and improved performance.

Emerging areas such as artificial intelligence, sustainability, and new organizational models are incorporated, as well as the strategic response to crisis situations such as the COVID-19 pandemic. This analysis demonstrates how effective strategic planning makes it possible to align labor objectives with the institutional mission, anticipate environmental changes, and foster more adaptive, cohesive, and sustainable organizations.

Throughout this work, we have analyzed emotional labor in the healthcare field. As we have seen, this concept has been investigated over the years by various authors. Despite extensive research, a clear definition has not been established, however, the scientific literature has revealed various dimensions and consequences derived from this concept. Likewise, the literature has examined the relationship between emotional labor and the variables of burnout and job performance. These relationship, have been established iver time by various authors through various investigations. Based on this theoretical framework, this final degree project aims to examine the various effects and consequences of emotional labor, such as emotional dissonance or the effects experienced by healthcare workers, taking into account gender, age, seniority, and professional category. However, to obtain the above data, an empirical study was conducted in two hospitals in A Coruña, with a simple of 65 workers, using the Franfurt Emotion Work Scales (Fews), the Maslach Burnout Inventory (MBI) and a questionnaire on job performance. The results of this study showed different significant relationships between the concept emotional labor and burnout and job performance, as well as a significant relationship between burnout and job performance. First, the significant relationship between emotional labor and burnout should be discussed, in which a negative relationship was found between positive emotions and emotional exhaustion and depersonalization. On the other hand, a significant relationship was found between the emotional dissonance dimension of emotional labor and all the burnout dimensions. Among the dimensions, we find emotional exhaustion, with which a negative relationship was found. Also, depersonalization, with which a negative relationship was found. Finally, personal accomplishment, with which a positive relationship was found. However, it should be mentioned that this study did not find any significant relationship between emotional labor and workers’ job performance. Finally, this study analysed the relationship between burnout and job performance, resulting in a positive relationship between both concepts. In short, it can be said that emotional labor in a complex concept and can have serious consequences for workers’ health, both physically and psychocologically.

On the other hand, this study also sought to examine the percentage of variance in occupational performance explained by stress variables, the perception of being exposed to workplace stressors, and workers' general health levels for both men and women. With a sample of 93 employees from Spanish companies, it was found that women reported significantly higher levels of work-related stress than men. However, no differences were found between the two groups in their perception of being exposed to workplace stressors, their general health, or occupational performance. Regression analyses, however, indicated that when the three variables are included in the analysis, women’s performance is explained solely by general health, accounting for 20.5% of the variance in performance. In the case of men, work-related stress and health were the variables that significantly explained performance, but not the perception of being exposed to stressors. Together, these variables explained 30.9% of the variance. These findings suggest that gender may influence how work-related stress is experienced and its effects on performance. The results of this study are discussed in the paper.

This undergraduate thesis examines Burnout Syndrome and defines it as a psychosocial phenomenon of significant relevance in the workplace in recent times. It explores its theoretical definition, its three core dimensions (emotional exhaustion, cynicism, and reduced personal accomplishment), as well as its prevalence across different professional sectors. Through a literature review, the physiological, social, psychological, and occupational consequences of Burnout are explored, highlighting its impact at both the individual and organizational levels. Additionally, the direct relationship between Burnout and decreased job performance is examined, emphasizing how this syndrome affects productivity, engagement, and the quality of work. In the empirical section of the study, the prevalence of Burnout was analyzed in a sample of 103 workers in the water sector. The results indicate low levels of Burnout in the general sample, although differences were found depending on job tenure and position. Furthermore, the relationship between Burnout and its dimensions with job performance was analyzed. The research findings show that overall Burnout levels in the sample were low, although significant differences were identified based on job role and seniority. In particular, individuals working in office, laboratory, and similar positions, as well as those with between 24 and 60 months of tenure, showed higher levels of exhaustion. Likewise, a negative correlation was observed between Burnout and job performance, especially in the dimensions of cynicism and reduced personal efficacy. Finally, the implications of these findings are discussed, concluding that Burnout not only affects individuals on a personal level but also poses a real risk to organizational efficiency. Therefore, the need to implement preventive measures and strategies to promote workplace well-being is emphasized.

At the same time, the situation of digital nomads in Spain will be analyzed, specifically in relation to their contributions and the benefits to which they may be entitled to request. This will allow us to visualize, in the clearest way possible, the situation of digital nomads when it comes to listing in Spain and the limitations and opportunities that this implies. The analysis carried out in this dissertation aims to study the historical evolution of the civil service and the current situation of the different rights of public employees in Spain, both exercised individually and collectively, with special attention to the provisions of the Basic Statute of the Public Employee and the Constitution. To do this, initially, a historical review has been carried out through milestones such as the Statutes of Bravo Murillo, of Mura or the 1963 Law of Bases up to the present day. Likewise, the different types of public employees have been analysed according to their level of employment relationship with the Public Administrations. As a result of all this, a series of conclusions have been drawn on the subject under study, from which we can deduce the dynamism of these rights and their necessary adaptation to the new socio-labour challenges, highlighting the fact that the level of security and rights enjoyed by public employees makes them an important option for citizens in terms of possible employment opportunities.

Suffering from an illness can often pose an obstacle to performing a work activity, putting the affected person’s job stability at risk. Historically, illness was not recognized as a ground for protection under Article 14 of the Spanish Constitution, so dismissals that occurred during a medical leave, if not based on a valid justification, were not considered discriminatory. This situation allowed many companies to part ways with workers in a vulnerable situation simply by paying compensation for unfair dismissal, without such dismissal being considered null and void. Discrimination was only acknowledged in cases of illnesses that generated social stigma or that, due to their nature, could be equated with a disability. However, with the entry into force of Law 15/2022, of July 12, on comprehensive equality of treatment and non-discrimination, illness and health status have been explicitly recognized as grounds for discrimination. This change has contributed to strengthening the legal protection of ill individuals against unjustified dismissals in the workplace.

This document analyzes the tax residence of legal entities from the perspective of tax law, addressing its acquisition and loss, as well as the implications arising from its determination. We begin with a preliminary delimitation of which entities are subject to income tax, distinguishing between legal entities with and without legal personality. We examine the concept of tax residence from the standpoint of domestic law, focusing on the connecting factors established by the Corporate Income Tax regulations, as well as the legal presumption of residence for entities located in low-tax jurisdictions. The role of permanent establishments and their relevance within the framework of tax liability is also addressed. On the other hand, we analyze the concept of residence in the international context, especially in Double Taxation Avoidance Agreements (DTAAs) and the OECD Model Tax Convention, highlighting the criteria used to resolve dual residence conflicts and the importance of the place of effective management. Furthermore, we delve into the loss of tax residence and its legal and tax consequences, with special attention to the “exit tax” regime regulated by Article 19 of Law 27/2014, of November 27, on Corporate Income Tax. Finally, the compatibility of this figure with European Union law is examined, through the case law of the CJEU and the transposition of Directive (EU) 2016/1164. All of this is contextualized in a globalized economic environment, where determining tax residence becomes especially relevant to avoid double taxation and ensure legal certainty for the taxpayer.

This academic work the analysis of industrial design as a legal protection mechanism within the framework of free competition, with a special emphasis on individual character as a key requirement for determining its validity. In today’s market, where innovation and differentiation are essential tools for competitiveness, industrial design acts as a mechanism that protects the external appearance of products against unlawful imitation. However, this exclusive right must be contextualized within the principle of free competition, which allows imitation unless it is expressly prohibited by law or leads to confusion or unfair advantage. Within this framework, the paper examines the notion of individual character, understood as the design’s capacity to produce a different overall impression on the informed user compared to previously disclosed designs. This analysis explores the various factors influencing the assessment of individual character, such as the designer’s degree of freedom and the perspective of the informed user, particularly through the lens of case law. The research conducted leads to the conclusion that this requirement not only limits the scope of legal protection, but also safeguards the dynamics of competition and prevents the abuse of rights. The paper highlights the importance of a legal framework that aligns with the reality of economic transactions, using legal instruments such as industrial design in the service of defending free market principles and protecting the interests of consumers.

The objective of this work is to study and propose the improvement of a bagging line in a real industrial environment. To carry it out, it takes into account the times and the way the activity is carried out by the operators, as well as ergonomic criteria that allow optimizing both the process performance and the working conditions. Thus, the research also focuses on the identification of operational deficiencies and ergonomic risks present in the different workstations that make up the line. Through a mixed methodological approach, a functional analysis of the production process is carried out, complemented with an ergonomic evaluation, using tools such as the REBA (Rapid Entire Body Assessment) method, direct observation and interviews with workers. Aspects such as forced postures, repetitive movements and manual lifting of loads are examined, with special attention to the factors that contribute to the appearance of musculoskeletal disorders. The results obtained make it possible to highlight those positions that most affect workers' health, to propose a series of improvements aimed at reducing physical risk and increasing the efficiency of the line. Furthermore, all proposals presented are aimed at creating a safer working environment.

For this reason, this Bachelor's Thesis aims to analyze the degree of use of selection tools in restaurants in Santiago de Compostela, seeking to provide a representative picture of the selection processes used in the sector within the city. Within this framework, administrative law not only acts as an organizational instrument but also as a means of legal oversight that ensures the legality, effectiveness, and transparency of the actions of the penitentiary administration. The paper examines the hierarchical organization of penitentiary institutions, which are equipped with collegial and individual bodies with specific powers, allowing for specialized technical management of key aspects such as living conditions, security, and rehabilitation. It also addresses the grading system, designed to individualize penitentiary treatment according to objective criteria and promote progression toward social reintegration. The study also highlights the importance of effective administrative management, reflected in the proper processing of permits, prison benefits, and disciplinary proceedings, as well as in the rational administration of the system's human and material resources. Finally, it emphasizes the importance of judicial and external oversight mechanisms, particularly the Penitentiary Surveillance Judge and the Ombudsman, as guarantors of compliance with constitutional principles and respect for inmates' rights against potential abuses of administrative power. In short, the study demonstrates the need for a legally sound prison administration, oriented toward legality, institutional effectiveness, and the protection of human rights as the basis for a modern and legitimate prison system.

This final degree project provides an in-depth analysis of the right to digital disconnection as a response to hyperconnectivity in the workplace. The study is based on the European and Spanish regulatory framework, focusing on the Organic Law on Data Protection (LOPDGDD), which recognizes this right but delegates its practical application to collective bargaining. The fundamental role of case law is highlighted, as rulings by the Supreme Court and the National Court were key in defining digital availability outside of working hours as effective working time and in requiring that any policy on the matter be negotiated, not imposed. The analysis also addresses the psychosocial risks arising from a lack of disconnection, such as stress and burnout syndrome. The main conclusion is that, although the right is legally recognized, its real effectiveness depends on collective bargaining, the work of inspections, and, fundamentally, a cultural change in companies that values rest as a pillar for health and productivity.

The study is based on the European and Spanish regulatory framework, focusing on the Organic Law on Data Protection (LOPDGDD), which recognizes this right but delegates its practical application to collective bargaining. The fundamental role of case law is highlighted, as rulings by the Supreme Court and the National Court were key in defining digital availability outside of working hours as effective working time and in requiring that any policy on the matter be negotiated, not imposed. The analysis also addresses the psychosocial risks arising from a lack of disconnection, such as stress and burnout syndrome. The main conclusion is that, although the right is legally recognized, its real effectiveness depends on collective bargaining, the work of inspections, and, fundamentally, a cultural change in companies that values rest as a pillar for health and productivity.

This study examines the labor and social unrest that affected the regions of el Bierzo, and more specifically Laciana, during their period of greatest industrial expansion, marked by the establishment of Minero-Siderúrgica de Ponferrada (MSP) in 1918, and their subsequent decline by 2013, when the company became part of Coto Minero Cantábrico. The analysis begins with a historical overview of the enterprise, the socio-economic characteristics of the affected communities, and the broader mining sector, establishing the necessary context for understanding the emergence and evolution of conflict. Special attention is paid to the spatial and temporal dimensions of these disputes, illustrating their persistence and intensity. The study underscores the central role of labor ando societal tensions in shaping the trajectory of mining activities in the region, suggesting that the history of MSP is inseparable from the contestation it generated.

This thesis analyzes whether there are differences in subordinates' perceptions of male and female leaders in relation to the leadership style used, the power bases they draw upon, and the satisfaction and loyalty they feel toward those leaders. To this end, a questionnaire was administered to a sample of 100 employees from various companies. Aspects such as leadership style, use of power, satisfaction, and loyalty toward their leaders were evaluated. The results show no significant differences in perceptions of leadership between men and women, except for a greater identification of men with coercive power. People-centered and transformational leadership styles are associated with more positive perceptions and greater loyalty, while coercive power does not favor loyalty. The implications of these findings for organizational practice are discussed in this paper. Finally, the limitations of the study are discussed, and future research is proposed.
